1. Agreement to Terms

By downloading, installing, accessing, or purchasing a license key for SurgeDL (the "Software"), developed by BizmoLabs, you acknowledge and agree to be bound by these Terms of Service and End User License Agreement (EULA). If you do not agree to these terms, do not install or use the Software.

2. License Grant & Permitted Devices

Upon valid purchase of a SurgeDL commercial license:

• SurgeDL PRO Single PC Edition ($9.99): BizmoLabs grants you a perpetual, non-exclusive, non-transferable license to install, activate, and operate the Software on one (1) personal computing device.
• SurgeDL PRO Power Pack / Family Edition ($16.99): BizmoLabs grants you a perpetual, non-exclusive, non-transferable license to install, activate, and operate the Software on up to two (2) personal computing devices concurrently (e.g., your primary workstation and a portable laptop).
• Evaluation / Free Trial: Grants a non-commercial, time-limited right to evaluate the Software's full feature set for up to thirty (30) days from initial launch.
• Updates: A valid commercial license entitles you to all standard feature enhancements, performance patches, and dynamic network resolver definitions released for that major version series (v2.x) with zero recurring subscription fees.

3. Permitted Use & Dual-Use Technology

SurgeDL is a high-speed, general-purpose multi-threaded download accelerator, network resumption utility, and local media organizer. It is engineered for lawful uses including, but not limited to:

• Accelerating large binary downloads, ISO distributions, open-source software, and public archives.
• Resuming interrupted or stalled HTTP, HTTPS, and FTP connections.
• Offline backup of user-authorized, public domain, Creative Commons, or personal media files.
• Converting user-owned audio/video formats locally on the user's personal hardware using bundled open-source tools (FFmpeg).

4. Copyright Compliance & Acceptable Network Use

SurgeDL is intended for personal offline archiving of user-authorized, public domain, or open-access media. Users are strictly responsible for respecting the copyright, intellectual property rights, and terms of service of any third-party websites or content providers they access.

You explicitly agree NOT to use the Software to:

• Circumvent or attempt to decrypt Digital Rights Management (DRM) technologies, including Widevine, FairPlay, or PlayReady.
• Infringe upon the intellectual property, copyright, trademark, or proprietary rights of any third party.
• Automate unauthorized harvesting or scraping of private personal data behind login credentials.
• Engage in denial of service (DoS) attacks or deliberately disrupt network infrastructure.

5. Order Processing, Payments & Merchant of Record

Payment processing, order fulfillment, invoicing, and tax collection (VAT, GST, Sales Tax) are conducted exclusively by our authorized online reseller, Paddle.com Market Ltd (or its affiliates, including Paddle Payments Ltd).

When you purchase a license, you enter into a binding sales contract directly with Paddle.com as the Merchant of Record. Paddle is responsible for billing, currency conversion, and applicable tax remittance to global authorities.

6. Digital Product Delivery Policy

SurgeDL is a digitally distributed software utility. There are zero physical shipping fees or transit delays:

• Immediate On-Screen Display: Upon successful transaction authorization by Paddle, your commercial serial key is displayed immediately on the checkout confirmation screen.
• Automated Email Dispatch: A formal receipt with your license key, activation steps, and installer download links is automatically dispatched to the email address entered at checkout within five (5) minutes.
• Self-Service Retrieval: If you ever misplace your email or serial key, you can instantly look it up at any time using our Self-Service License Key Recovery Portal or by contacting support@surgedl.com.

7. Refund Policy & 30-Day Guarantee

We offer a transparent 30-Day 100% Money-Back Guarantee. If SurgeDL fails to function as advertised or does not meet your expectations, you are entitled to a full refund within thirty (30) days of your original purchase date.

To initiate a refund, you may submit a request directly through our Refund Policy portal, contact Paddle at paddle.net, or email our support desk at support@surgedl.com with your order number.

8. Disclaimer of Warranties & Limitation of Liability

The Software is provided "as is" without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, BizmoLabs disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

In no event shall BizmoLabs or its licensors be liable for any consequential, incidental, indirect, or punitive damages, including loss of data, network provider bandwidth overages, or local system downtime.
